N.Y. Appeals Court Rules Injured Weightlifter’s 3-Month-Late-Filed Notice of Claim Against NYC May Move Forward

New York’s Appellate Division, First Department overturned a lower court’s dismissal of a plaintiff’s claim against the City of New York. In an action for personal injuries resulting from an incident at a city-run recreation center, the Supreme Court dismissed plaintiff’s claim for failing to file a notice of claim within the required 90 days. While plaintiff failed to file a notice of claim upon the City of New York within the 90 claims, the appellate division allowed for the late filing finding that the City did have notice of the claim and did not sustain significant prejudice by the late filing.
