Case Against Expert Doctor for Refusal to Give Testimony Denied by the Courts

A New Jersey appeals court refused to revive a lawsuit brought against a doctor who would not testify at his personal injury trial. Plaintiff’s action resulted when he settled his underlying lawsuit for less than he felt entitled to due to the fact that his doctor, the defendant, refused to testify at trial. The court found that there was no testimony to support plaintiff’s claim that his case would have been more valuable due to the doctor’s testimony and affirmed the lower courts granting of summary judgment dismissing the case.
