NYC Housing Authority Must Face Lead Poisoning Suit

A New York appellate court reversed a trial court’s dismissal of a child’s lead poisoning suit against the New York City Housing Authority. Testing done in the plaintiff’s apartment relied upon in NYCHA’s motion was done three years after the child’s lead levels were first detected and therefore not probative in deciding summary judgement. The reversal of the trial courts decision allows for plaintiff’s lawsuit against NYCHA to move forward.
